High Criminal Court Lawyers and High Criminal Courts

The jurisdiction of High Criminal Courts is defined by Article 12 of Law No. 5235 on the Establishment, Duties, and Powers of First Instance Judicial Courts and Regional Courts of Justice. Pursuant to the provisions of this article;

“Without prejudice to cases where other laws specifically assign jurisdiction, High Criminal Courts are responsible for hearing cases and matters related to crimes stipulated in the Turkish Penal Code, such as robbery (Art. 148), extortion by public officials (Art. 250/1 and 2), forgery of official documents (Art. 204/2), aggravated fraud (Art. 158), fraudulent bankruptcy (Art. 161), crimes defined in Chapters Four, Five, Six, and Seven of Part Four of Book Two of the Turkish Penal Code (excluding Articles 318, 319, 324, 325, and 332), and crimes falling within the scope of the Anti-Terrorism Law No. 3713 dated 12/4/1991, as well as crimes requiring aggravated life imprisonment, life imprisonment, and imprisonment for more than ten years.” (Law No. 5235 on the Establishment, Duties, and Powers of First Instance Judicial Courts and Regional Courts of Justice, Art. 12.)

With the publication and entry into force of Law No. 6545 on Amendments to the Turkish Penal Code and Certain Other Laws in the Official Gazette dated June 28, 2014, the abolition of Magistrates' Criminal Courts, as a result of the amendment made to the first paragraph of Provisional Article 6 added to Law No. 5320, has further increased the number of crimes heard by Courts of First Instance Criminal Jurisdiction, thereby rendering High Criminal Courts much more exceptional in nature compared to previous periods.

Pursuant to Article 9 of Law No. 5235, a High Criminal Court consists of a President and a sufficient number of members. The High Criminal Court convenes with a president and two members to hold hearings and render decisions. The attendance of the Judicial Panel, consisting of the court president and two members, along with the Public Prosecutor, is mandatory for hearings.
